Subject: Think You Know The Law of Self-Defense?

Think you understand the laws regarding self-defense? Then let's test your knowledge with a few questions:
  1. Can you use deadly force in a scenario where you are being physically assaulted by another person?
  2. If someone breaks into your home at night, can you legally shoot them? What about if it's in the daytime?
  3. Can you shoot someone to prevent them from stealing your property?
  4. If you are ever in a physical altercation and you say, "I was in fear of my life," you will not be charged with a crime. True or false?
  5. It is legal to draw a firearm and fire a "warning shot" if someone is threatening you with physical harm. True or false?
If you don't know the answers to these questions with absolute certainty, then you might want to brush up on your knowledge of self-defense laws. 

In keeping with the theme of the newsletter over the last few weeks, I thought I'd send you a link to a very good resource for self-defense law education and info.

This YouTube channel features videos from an attorney who literally wrote the book on the legalities of self-defense. I suggest that you scroll through the list, find the presentation that correlates with your state of residence, and watch the video.


And of course, if you live overseas seek out a legal expert who know the laws in your country and legal jurisdiction.

P.S. - The answer to almost every one of those questions above is, "It depends." For question #1, it depends on whether or not you have a stand your ground law in your state, and whether or not the assailant is using what a court would consider to be "deadly" force. As for questions #2 and #3, you can in Texas if it's at night, and in some circumstances during the day as well... but I have no idea about other states. Regarding question #4, the first thing a prosecutor will say is, "If you were so afraid, why didn't you flee?" Question #5 will get you put in jail in most states, and rightly so. 

P.S.S. - I love living in Texas. Most Californians won't admit it, but the real reason they move here is because of the gun laws. Well, that and because the Mexican food is better.
