2025 Election Data: The Speed Factor |
|
|
Our analysis of 1,593 elections in 2025 confirms what practitioners already sense: speed kills. Union win rates hit 85.7% when elections happen within 14 days of petition filing and drop to 50% after 366 days. The 26-day gap between average timelines in union wins versus company wins tells the story.

Strikes and Organizing Activity |
|
|
Michigan healthcare is in crisis mode. A six-month nursing strike at Henry Ford Genesys, a looming 10,000-nurse walkout at Corewell Health East, and the Teamsters aggressively expanding into healthcare organizing across the state. Meanwhile in Colorado, 3,800 JBS/Swift workers launched the first major meatpacking strike in 40 years. And Starbucks agreed to restart bargaining March 30 after SWU's four-month strike fizzled.

The Organizing Ecosystem You May Not Know About |

The Southern Workers Assembly is running multi-day blitz campaigns across the South, targeting multiple employers across industries simultaneously. They are not a union and cannot organize directly, but they are funded by every major union and serve as a pipeline to traditional organizers. An upcoming blitz in Upstate South Carolina is scheduled for April 20-25.

Captive Audience Laws: 13 States and Counting |
|
|
Thirteen states have now enacted bans. Minnesota's law survived the Eighth Circuit and the Supreme Court denied cert on February 26. California's ban was blocked by injunction. New Jersey expanded its law in December. None have been overturned. We presented a state-by-state diff-in-diff analysis of how these laws are affecting union win rates, and the results are more nuanced than you might expect.

NLRB, Cemex, and Board Reform |
|
|
Cemex keeps losing ground. The Sixth Circuit declined to enforce a Cemex bargaining order and found the Board exceeded its authority. Courts appear content to issue Gissel orders and let Cemex fade quietly. Meanwhile, Ex-Cell-O survived the Biden Board's attempt to overturn it, GC Crystal Carey's memo GC 26-03 is reshaping the Board's enforcement posture, and we discussed what the likely end of removal protections in Trump v. Slaughter means for the future composition of the Board.
