ACTION ALERT: Act Now for Agritourism in Utah: New Bill Requires Specific Signage
Hearing Is Thursday, Feb. 8, 2024!

A Utah house bill  (HB 31) would require specific signage to be placed at any agritourism location, and change other language within the bill. A hearing on HB 31 "Agritourism Amendments" will be held before the Utah Senate Judiciary, Law Enforcement, and Criminal Justice Committee at 2 p.m. on Thursday, Feb. 8,, 2024.

The new bill language reads that signage is required and that it (a) is printed in black letters, that are a minimum of one inch in height, on a white background; and (b) states, "WARNING: Under Utah law, an operator of an agritourism activity or the
 property where the activity takes place is not liable for the injury, illness, death, or damage to personal property of a participant that primarily results from the inherent risks of the activity or a participant's failure to follow instructions or exercise reasonable caution. You are assuming the risk of participating in or observing an agritourism activity."

1. HB 31 would increase the burden on Utah agritourism operations to meet signage requirements..

2. HB 31 would potentially make agritourism businesses in the state of Utah vulnerable to increased liability and frivolous, expensive lawsuits.


3. HB 31 would potentially increase liability for agritourism operations, thereby decreasing the number of farms willing to open their grounds to consumers.
