The Indianapolis-Marion County rental assistance program opened up recently with new money from the federal government.  All of your tenants who are behind in rent should be applying.  We are doing our part to ask/require delinquent tenants to do so.  

There is a significant change in the Indianapolis program that is causing us to review and consider each request.  It is important that our Indianapolis-Marion County property owners are aware of this issue. 

If we accept the assistance money, we are required to wait until the CDC Order expires (currently June 30) before taking further legal action against the tenant. Considering that the CDC Order has been extended several times since Sept 1, 2020, it is possible that acceptance of these funds may provide just short term relief and protect your tenant from an eviction for a longer time.  We have seen Judges be very hesitant to act on any tenant with a CDC Declaration.  It has not mattered if there is a terminated or expired lease, or clear lease violations.  So, accepting these funds is a little bit of a gamble with immediate benefits and potential long term losses (if the CDC Order does not end June 30).

Keep in mind that we have been warned that some Judges will not look kindly on landlords who do not participate in this program.  With that being the case, it seems acceptance of assistance funds in most cases will be the correct bet.
