Rental Assistance Funds Arrive For Indy-CDC Extends Moratorium

It has been a busy week!  On Monday we learned that the CDC Declaration that prohibits evictions for any tenant who completes it, has been extended through June 30 On the same day we finally found out that the Indianapolis-Marion County Rental Assistance program will reopen for applications on Monday April 5. If approved a household could get up to three months of assistance including back rent.   

Eligible households are those where at least one individual meets the following criteria: qualifies for unemployment or has experienced a reduction in household income, incurred significant costs, or experienced a financial hardship due to COVID-19; demonstrates a risk of experiencing homelessness or housing instability; and has a household income at or below 80 percent of the area median.

We have notified all tenants and specifically will be guiding all tenants who have filed the CDC declaration to apply for assistance.  Our legal team is reviewing new approaches to going to court on these CDC declarations.  Unfortunately, the extension document went from a few pages to 17 and appears to have closed some of the previous developed strategies.  As we have been told by legal..the CDC Declaration extension is "as clear as mud."

We will figure it out.

Know Indiana Security Deposit Law
It is prudent to always include a security deposit in a lease contract. A security deposit is included in the terms of most lease agreements. The purpose of the security deposit is to set aside funds for the protection of the owner of the property from violations of the lease agreement.
