Here Come The Tenant Protections

We have previously shared with you that the Indianapolis Marion County Tenant Protection Act would begin July 1.  With the pandemic taking most of our government leaders time, not much had been brought forward as to just how the tenants rights would be spelled out.  We knew there would be language added to our lease and we were not quite sure how we would do that unless we created a separate Marion County lease.  

Well..wonder no more. 

Some of you have reached out as you received a email from the Indianapolis Director of Public Health and Safety.  If you didn't here is a reprint of that email.
What An Owner Needs To Know:

Providing resources for tenants is a key element of the tenants’ rights initiative proposed by Mayor Joe Hogsett in January 2020. The ordinance package, passed by the City-County Council in February 2020, also offers new legal protections against landlord retaliation. If a landlord is found to have retaliated against a tenant in response to the tenant’s exercise of his or her rights, the landlord now faces a penalty of $2500, or $7500 for a repeat offense. These are the maximum monetary penalties allowed under Indiana law.



Update On Re-Opening Indy

As we discussed last week, Indianapolis is not following the exact dates or permissions granted in all the Indiana Back On Track plan.  This is primarily due to Marion County leading the state in COVID cases and deaths. 

For those following this (and keep it all straight) the following published in the Indy Star May 14 will provide some further guidance. 
At this time we are still leaving our office closed to the public.  We are meeting tenants with a scheduled appointment in front of our office.  We also have not re-started in person inspections.  These policies will surely be adjusting over the next few weeks. 

Evictions

The courts are still closed throughout Central Indiana.  We have been putting all of our collections energy into posting and re-posting demand notices to tenants that have been non-responsive.  We are also updating all of our evictions packages in anticipation of being able to re-file cases on June 1.  We will keep you informed as we share your goal of getting paying tenants into your homes during these summer months.
