2. BIR AMENDS THE MANDATORY INFO CONTAINED IN INVOICE TO INCLUDE WITHHOLDING TAX

Revenue Regulations (RR) No. 006-2026, issued on October 1, 2026, amends Section 6(B) of RR No. 07-2024 to require the inclusion of Creditable Withholding Tax (CWT) information as a mandatory item in invoices. Specifically, the regulations require that the amount of CWT, where applicable, be shown as a separate item on the invoice to enhance tax compliance and support the implementation of the Ease of Paying Taxes (EOPT) Act (Republic Act No. 11976). During the transition period, taxpayers may continue using existing unused invoices, provided that the phrase “Less: Withholding Tax” is conspicuously stamped on the face of the invoice. Thereafter, all newly printed invoices must reflect the same information before use.

3. BIR IMPOSES WITHHOLDING TAX ON IEMOP GROSS REMITTANCES TO GENERATION COMPANIES & OTHER WESM MARKET PARTICIPANTS

Revenue Regulations (RR) No. 005-2026, issued on October 1, 2026, further amends RR No. 2-98, as amended, by imposing a 2% Creditable Withholding Tax (CWT) on gross remittances made by the Independent Electricity Market Operator of the Philippines (IEMOP) to generation companies and other market participants for electricity sold through the Wholesale Electricity Spot Market (WESM). IEMOP is designated solely as the withholding agent and is required to deduct and remit the tax based on the total amount payable before any deductions.

 

Highlights include the 2% CWT on gross WESM remittances, IEMOP’s designation and responsibilities as withholding agent, filing and remittance requirements through the Electronic Filing and Payment System (eFPS), issuance of BIR Form No. 2307, and submission of the prescribed certified list of electricity buyers to the Large Taxpayers Service.

4. BIR CLARIFIES eDST IMPLEMENTATION

Revenue Memorandum Circular (RMC) No. 107-2026, issued on October 1, 2026, clarifies certain issues and concerns relating to the implementation of the Enhanced Electronic Documentary Stamp Tax (eDST) System pursuant to Revenue Regulations (RR) No. 28-2025. It requires all taxpayers covered by RR No. 28-2025 to enroll in the Enhanced eDST System on or before December 31, 2026, while newly registered covered taxpayers must enroll within 90 days from their BIR registration.

 

Highlights include mandatory enrollment in the Enhanced eDST System and eFPS, required orientation prior to system use, separate enrollment and registration requirements for Notaries Public, refund procedures for erroneous or multiple affixture of documentary stamps, procedures for reporting system-related issues through a Trouble Ticket Number (TTN), and penalties for failure to enroll within the prescribed period. Pending enrollment, covered taxpayers must continue complying with their documentary stamp tax obligations under existing laws, rules, and regulations.
