BREAKING: NLRB General Counsel Lays Out Precedents She Wants Revisited

NLRB General Counsel Crystal Carey issued GC Memo 26-04 today, giving employers a clear look at the Board precedents she has already challenged and those she intends to challenge when the right cases arise.

Among the major targets are McLaren Macomb, Stericycle, Amazon, Cemex, Lion Elastomers II, Valley Hospital, and Thryv.

The memo does not change current law. Carey specifically directs the Regions to continue applying existing Board precedent unless and until the Board changes it.

The practical takeaway: several of the most consequential NLRB decisions of the last few years are now officially in play.
