Subject: Class Action Lawsuit Against Logisticare

Hello to everyone in the Million Dollar Community!  As always, I hope this message finds you all doing well and business is booming!

I had a conference call this afternoon with a legal team researching the prospects of a class action lawsuit against Logisticare and possibly MTM.  We spoke for about 45 minutes with plan for more conversations.

In an effort to make this message as brief, yet, as informative as possible, I will share the following particulars in bullet form:
  • In representing a client who is suing Logisticare and witnessing some of their corrupt practices, this law firm discovered what they believe are very real prospects of a class action lawsuit

  • This law firm reached out to us in hopes of leveraging the UMTPG to reach and uncover transportation providers who have legitimately suffered direct damages as of the result of serving as a subcontractor for Logisticare

  • Although I love the thought and prospects of a class actions lawsuit against Logisticare, such an endeavor requires a great deal of work on the part of the attorneys, my team and me, and you, in preparing the necessary evidence and documentation of your experience and damages

  • As I explained to the attorneys, I welcome the opportunity to explore such possibilities and assist as necessary, but my team and I are exceptionally busy and will need to "proceed with caution."  If taking on the added responsibilities and efforts of what would most likely be a protracted endeavor prove to be problematic for our business and operation, I reserve the right to "pull the plug"

  • ONLY if (1) you are an active UMTPG member, and (2) your business has literally suffered damages as a direct result of subcontracting with Logisticare will you be considered

  • Yes, you NEED to be an active UMTPG member - not because it would preclude you legally from pursuing a lawsuit, but honestly, if you're not going to be invested in us my team and I simply don't have time to invest in reviewing and helping prepare your information 

  • In regards to the work on your part, we need documentation, documentation, and more documentation  

  • First and foremost, we need a professionally prepared brief, 1-2 pages in length, summarizing how you sustained damages as a result of working with Logisticare.  At the top, please include the full legal name of your business with associated contact information, names of all principals with ownership percentages, date of formation and dissolution if applicable, and associated contact information

  • Thereafter, please include a well-written summary of how you sustained damages including how long you served Logisticare, the amount of money they owe(d) you in arears, the adverse impact on your business, and examples of clear breach of agreement via your broker agreement   

  • I stress well-written because if you send us chicken $hit thinking we can turn it into chicken salad, it's not going to happen!  Seriously, don't send us crap!  ANYTHING you send us must be professionally prepared via Word Doc or PDF and must be able to be proven and supported by documentation    

  • In the future, we will eed copies of P/L statements, copies of broker agreements, email correspondence between you and Logisticare representatives illustrating and supporting your claims, and all other supporting documentation, BUT we don't need that any time soon.  For now, we only need a 1-2 page professionally prepared brief 
  • I can't stress this enough, your 1-2 page brief needs to be professionally prepared and written underscoring dates, dollar amounts, locations, people, etc.  Do not send us crap!  If you can't literally substantiate your claims with evidence then it is absolutely worthless
I am highly confident I am failing to mention some particulars, but needless to say, I'll be sharing more information as we move forward, learn more, and have further conference calls.  Again, this is going to be a protracted long-term effort so we have time.  

This law firm is definitely excited by the prospects of partnering with the UMTPG because we have members in roughly 45 states.  However, if we don't have adequate, substantiated participation from enough providers with legitimate damages via Logisticare, no one is going to move forward.  A class action lawsuit is based on volume in addition to legitimate damages.

Definitely use this message as "food for thought" so you can begin thinking about what you need to do and prepare if you are indeed a "victim" of Logisticare.  Keep checking your email for further details and updates as I am sure there will be plenty over time and as things develop.
