Dear Friend,

Delaware Senate Bill 273, also known as "The Consumer Choice Milk Act," would legalize the sale of raw milk in the state of Delaware by allowing farmers to attain a raw milk permit that exempts permit holders from the current milk code.


Currently, producers cannot sell raw milk to consumers in the state of Delaware. The bill is expected to be heard before the Senate Agriculture Committee on May 15, 2024, although the date and location are subject to change. More information will be sent to those able to testify when the committee finalizes the schedule at the end of the week.


This bipartisan bill is primarily sponsored by Senator Eric Buckson (R), as well as Senators Kyra Hoffner (D) and Dave Lawson (R).

Action Step #1


Email us if you are willing to testify in support of SB 273 to talk about the impact this bill will have on expanding producer and consumer choice. You will be able to provide public comments in person or by Zoom. You must register either way. There will be a sign-in sheet for those who can testify in person and a Zoom registration link for those testifying via Zoom.

TALKING POINTS


1. This is a freedom of choice issue. Everyone has the legal right to consume raw milk, but with the current ban on sales, there is no way for many to exercise that right. Neither the Department of Agriculture and Forestry nor any other government agency or official should have the right to dictate to people what foods they can and cannot eat. 


2. SB 273 could help farms in the state dairy’s industry stay in business. The Raw Milk Institute estimates that raw milk producers can earn nearly ten times the profit compared to regular milk sales.


3. Raw milk has a good record for safety. As demand for raw milk has skyrocketed in recent years, the number of illnesses attributed to raw milk consumption has remained flat or even gone down.


4. The media and public health agencies have been warning people not to drink raw milk because of Highly Pathogenic Avian Influenza (HPAI). There is no evidence that HPAI in raw milk or any other food can make people sick.
