Subject: CASS Newsletter - AML-CFT (Reliance on Regulated Persons) Regulations

In an effort to strengthen its AML/CFT framework, the Government of Seychelles has recently introduced the Anti-Money Laundering and Countering the Financing of Terrorism (Reliance on Regulated Persons) Regulations (“Regulations”) on 20th November 2023.


Reporting entities may rely on a regulated person, including a foreign regulated person, to apply customer due diligence measures in respect of a customer, as provided by Section 42 of the Anti-Money Laundering and Countering the Financing of Terrorism Act 2020.


In line with the aforementioned, these Regulations have come to light to provide a framework for the reliance on regulated persons by reporting entities. The key provisions of the Regulations are as follows:

Regulation 6 concludes the Regulations by providing that:


“Every reporting entity shall ensure that any reliance arrangement that were in existence between the reporting entity and a regulated person shall comply with the provisions of these regulations within 12 months of the coming into force of these regulations.”
