Changes to Federal Privacy Regulations for Sharing SUD Treatment Information
What you need to know…
  • The recent CARES Act, signed into law on March 27, 2020, included a provision to permanently change the SUD confidentiality law, 42 USC 290dd-2, and will require changes to the regulations at 42 CFR Part 2.
  • These changes will not go into effect until March 2021. Until that time, the current law and regulations continue to apply.
  • The Center of Excellence for Protected Health Information will be available to provide Technical Assistance and training as SAMHSA provides additional information and guidance related to these amendments.
Funded by SAMHSA, the CoE-PHI develops and disseminates resources, training, and TA for states, healthcare providers, school administrators and individuals and families to improve understanding and application of federal privacy laws and regulations, including FERPA, HIPAA, and 42 CFR Part 2, when providing and receiving treatment for SUD and mental illness.
