CARES Act Update:
Changes to Federal Privacy Protections for SUD Treatment Information
What you need to know:
The CARES Act, signed into law on March 27, 2020, included a provision to permanently change the SUD confidentiality law, 42 USC 290dd-2, and will require changes to the regulations at 42 CFR Part 2.

These changes will not go into effect until SAMHSA and HHS finalize changes to the regulations at 42 CFR Part 2. Until that time, the current law and regulations continue to apply.

The Center of Excellence for Protected Health Information will be available to provide Technical Assistance and training as SAMHSA provides additional information and guidance related to these amendments.

Stay tuned for an upcoming training on the current state of the federal privacy protections for substance use disorder treatment!
Funded by SAMHSA, the CoE-PHI develops and disseminates resources, training, and TA for states, healthcare providers, school administrators and individuals and families to improve understanding and application of federal privacy laws and regulations, including FERPA, HIPAA, and 42 CFR Part 2, when providing and receiving treatment for SUD and mental illness.

Resources, training, technical assistance, and any other information provided through the CoE-PHI do not constitute legal advice.
