| | A Message on Counterfeit Devices

| | We are all being affected by the infusion into our markets of low-quality, counterfeit devices. Those devices often do not function properly, do not have a reputable company standing behind them, and leave locations and players with a negative view of electronic skill games.
Intellectual property (“IP”) theft is a worldwide problem that affects a broad spectrum of industries, including ours, and harms American businesses and workers. While our government, including the U.S. Trade Representative, is working to highlight and address these problems, Banilla is doing its part to go after the problem too. Indeed, Banilla takes the protection of its games and their underlying IP seriously.
Over the past 2 years, Banilla has sent dozens of cease-and-desist letters and, when those efforts fail, has brought 35 cases for IP infringement against locations, route operators, and domestic and Chinese manufacturers who place and traffic in counterfeit products. Those cases have been in ten federal judicial districts across six states. The awards and settlements in those matters and cases have amounted to approximately $1.6 million dollars in penalties and counting. And those awards and settlements have included several “six-figure” amounts, including an award of damages and attorneys fees in Texas for nearly $339,000 for willful infringement. “The lesson for the unscrupulous is simple: Dabble in counterfeit Banilla devices, and the company will find you and bring you to account,” said Marc Downing, Chief Counsel of Banilla Games.
